Welcome to OBGYN.ph. These Terms of Service (“Terms”) govern your access to and use of the OBGYN.ph website, mobile applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About OBGYN.ph

OBGYN.ph is a Philippine-based online telemedicine platform that facilitates access to obstetrics and gynecology-related health information and connects users with duly licensed physicians for online consultations, in accordance with applicable Philippine laws and regulations, including the Telemedicine Practice Guidelines issued by the Department of Health (DOH) and the Professional Regulation Commission (PRC).

OBGYN.ph does not operate as a hospital or clinic and does not replace in-person medical care when physical examination or emergency intervention is required.

2. Eligibility

You must be at least eighteen (18) years old to use the Service. By using OBGYN.ph, you represent and warrant that you are legally capable of entering into a binding agreement.

3. Medical Disclaimer

  • The Service is provided in compliance with Philippine telemedicine guidelines and is intended for non-emergency medical consultation and health guidance only.
  • Online consultations are limited by the absence of physical examination and diagnostic testing.
  • In case of a medical emergency, users must immediately contact local emergency services or proceed to the nearest hospital.
  • Medical advice is provided based on the information disclosed by the patient and clinical judgment of the physician.
  • OBGYN.ph does not guarantee medical outcomes, diagnoses, or treatment effectiveness.

4. User Accounts

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your login credentials
  • Notify OBGYN.ph immediately of any unauthorized use of your account

You are responsible for all activities conducted under your account.

5. Online Consultations

  • Online consultations are conducted via secure chat, voice, or video platforms.
  • All physicians on OBGYN.ph are required to be licensed by the Professional Regulation Commission (PRC) and compliant with Philippine medical laws.
  • Physicians exercise independent medical judgment and are not employees of OBGYN.ph.
  • Prescriptions, medical certificates, or referrals may be issued at the physician’s discretion and in accordance with Philippine regulations.

6. Punctuality, Late Arrival, and No-Shows

6.1 Grace Period for Patient Lateness

Patients are required to log in to the virtual consultation room at least 5 minutes prior to their scheduled appointment time. In the event of a delay, the attending physician will remain in the virtual consultation room for a maximum grace period of ten (10) minutes past the scheduled start time.

6.2 Declaration of No-Show

If a patient fails to enter the virtual consultation room within the 10-minute grace period, the session will be formally designated as a “No-Show,” and the consultation link will automatically expire. The physician is not obligated to extend the session or wait beyond the 10-minute window, in order to maintain scheduled care for other patients.

6.3 Rebooking Requirements and Fees

In the event of a designated No-Show:

  • The original scheduled appointment is deemed forfeited and non-refundable.

  • To proceed with care, the patient must book a new appointment slot through the OBGYN.ph platform.

  • A mandatory rebooking fee of 290 PHP will apply to secure a new consultation schedule.

6.4 Standard Time Zone for Consultations

To ensure precise scheduling and coordination, all appointment slots, notifications, and confirmed online consultations are strictly conducted under Philippine Standard Time (PST), which is GMT +8 (Manila Time). Patients accessing the platform from different regions or countries are solely responsible for converting and tracking their appointment times to align with the GMT +8 standard.

7. Fees and Payments

  • Some services may be offered free of charge, while others require payment.
  • Fees, billing terms, and payment methods will be clearly disclosed prior to purchase.
  • Payments are non-refundable unless otherwise stated.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using OBGYN.ph, you consent to the collection and use of information as described in the Privacy Policy.

9. Acceptable Use

You agree not to:

  • Use the Service for unlawful or fraudulent purposes
  • Provide false or misleading information
  • Harass, abuse, or harm healthcare providers or other users
  • Attempt to interfere with the platform’s security or operations

OBGYN.ph reserves the right to suspend or terminate accounts that violate these Terms.

10. Intellectual Property

All content on OBGYN.ph, including text, graphics, logos, and software, is the property of OBGYN.ph or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or modify any content without prior written consent.

11. Limitation of Liability

To the fullest extent permitted by law, OBGYN.ph shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including reliance on medical advice obtained through the platform.

12. Indemnification

You agree to indemnify and hold harmless OBGYN.ph, its officers, directors, partners, and affiliates from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.

13. Termination

OBGYN.ph may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is deemed harmful to the platform or its users.

14. Modifications to the Terms

OBGYN.ph reserves the right to modify these Terms at any time. Updates will be posted on this page, and continued use of the Service constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
